ELD Mandate Enforcement By State: Who’s Writing Tickets?

 

While the FMCSA announced that ELD violations won’t affect CSA scores — or result in out-of-service orders — until April 1, 2018, many states have already begun enforcing ELD rules. In states already enforcing ELD mandate rules, failure to meet ELD compliance today could result in fines and citations, and no matter what this map looks like now, failure to meet ELD compliance by April 1, 2018 will result in CSA dings and out-of-service orders. According to Overdrive, and as of February 2, 2018, the states above in orange and dark gray have confirmed their ELD enforcement intentions prior to the April 1, 2018 ELD enforcement date. Orange states are writing tickets based on the individual officer’s discretion, and dark gray states are waiting until April 1, 2018 to issue tickets. States in light gray haven’t confirmed their ELD enforcement intentions yet, as some may not legally be able to enforce the ELD mandate just yet. Also worth noting on each individual state’s ELD adoption processes is the ongoing Owner-Operator Independent Drivers Association (OOIDA) petition, which states that 26 states haven’t adopted the ELD mandate and 20 states haven’t adopted current federal motor carrier safety regulations in at least three years. Some of the 26 states caught in the middle of OOIDA’s petition don’t agree, however, stating that their regulatory codes are up-to-date, including the ELD mandate.

You can expect the following states to enforce ELD mandate rules prior to April 1, 2018, however, enforcement is entirely dependent upon the discretion of the individual officer you encounter:
